Tijarah – Terms & Conditions

Welcome to Tijarah! By downloading, accessing, or using this app, you agree to be bound by these Terms & Conditions. Please read them carefully before using the platform.

1. General Overview

Tijarah is a user-driven marketplace platform where individuals can list and sell products locally. Tijarah does not manufacture, sell, verify, or endorse any products listed on the platform. All transactions occur directly between buyers and sellers, and Tijarah acts solely as an intermediary platform connecting users.

Important: Your use of Tijarah is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using Tijarah, you agree to both these Terms and our Privacy Policy.

2. User Accounts

2.1 Account Registration

Users must register an account using Google Sign-In to list or purchase products
You are responsible for maintaining the security of your account credentials
You agree to provide accurate, current, and complete information during registration
You must comply with all applicable local, state, and national laws when using the platform

2.2 Age Requirement

You must be at least 18 years old to create an account and use Tijarah independently
We do not knowingly allow users under 13 years of age to use Tijarah

2.3 Account Security

You are solely responsible for all activities that occur under your account
Notify us immediately at contact.shafaqat.tech@gmail.com if you suspect unauthorized access
Do not share your account credentials with anyone
You are liable for any actions taken using your account

3. User-Generated Listings

3.1 Listing Responsibility

All listings are created and managed by individual users
Tijarah does not inspect, approve, guarantee, or verify the quality, authenticity, legality, or safety of any listed product before it goes live
Users must ensure that all listings are truthful, accurate, and comply with applicable laws

3.2 Content Moderation

All listings are subject to automated filtering and manual admin review
We reserve the right to remove any listing that violates these Terms without prior notice
Repeated violations may result in account suspension or permanent ban
Users can report suspicious or inappropriate listings through the app

3.3 Listing Standards

Provide accurate product descriptions, prices, and photos
Do not use misleading titles or descriptions
Ensure all images are original or you have rights to use them
Update or remove listings promptly when items are sold or no longer available

4. Transactions and Liability

4.1 Transaction Responsibility

Buyers and sellers are solely responsible for completing transactions
Tijarah does not process payments, handle shipping, or facilitate delivery
All transaction terms (price, payment method, delivery) must be agreed upon directly between buyer and seller
We strongly recommend meeting in safe, public locations for in-person transactions

4.2 Platform Liability

Tijarah is not liable for any loss, damage, fraud, disputes, or issues arising from any transaction or product listed on the platform
Users agree to resolve disputes directly with each other
We do not mediate or arbitrate disputes between buyers and sellers
Tijarah does not guarantee that transactions will be completed successfully

5. Prohibited Items

Users must not list the following items on Tijarah:

Illegal substances, drugs, narcotics, or controlled substances
Counterfeit, fake, or replica products
Stolen goods or items of questionable origin
Weapons, firearms, ammunition, explosives, or weapon accessories
Adult content, services, or explicit materials
Live animals
Tobacco, alcohol, or vaping products
Prescription medicines or medical devices
Fake documents, IDs, currency, or government-issued items
Hazardous materials, chemicals, or pesticides
Items that infringe on intellectual property rights (copyrighted, trademarked)
Pyramid schemes, multi-level marketing (MLM), or get-rich-quick schemes
Event tickets for resale above face value (scalping)
Human organs, body parts, or bodily fluids
Endangered species or protected wildlife products
Hacking tools, spy equipment, or surveillance devices
Any items that violate Jammu & Kashmir, Indian, or international laws

Tijarah reserves the right to remove any listing that violates these prohibitions. Severe or repeated violations will result in permanent account termination.

6. In-App Messaging

6.1 Messaging Guidelines

In-app messaging is for transaction-related communication only
Be respectful, professional, and honest in all communications
No spam, harassment, threats, or abusive language
No solicitation of business outside the platform or sharing of external links

6.2 Rate Limiting

Message rate limits are enforced to prevent spam
Excessive messaging may trigger temporary restrictions
Repeated violations may result in account suspension

6.3 Message Retention

Chat messages are stored until manually deleted by users
Messages are automatically deleted after the associated listing expires
Deleting your account does not automatically delete messages from other users' inboxes

7. User Conduct

Users must adhere to the following conduct standards:

Honesty: Provide truthful and accurate information in all listings and communications
Respect: Treat all users with courtesy and professionalism
No Fraud: Do not engage in scams, phishing, identity theft, or fraudulent activities
No Harassment: Do not bully, threaten, stalk, or harass other users
No Spam: Do not send unsolicited messages or advertisements
Report Issues: Report suspicious activity, prohibited items, or policy violations immediately
Follow Laws: Comply with all local, state, and national laws and regulations

8. Safety Tips

To ensure safe transactions, Tijarah recommends the following:

Verify Identity: Check seller/buyer profiles, ratings, and reviews before transacting
Meet Publicly: Conduct in-person exchanges in well-lit, public places during daylight hours
Inspect Products: Thoroughly inspect items before making payment
Secure Payments: Use secure payment methods and avoid wire transfers or cryptocurrency for unknown sellers
Protect Privacy: Never share sensitive personal information (bank details, passwords, ID numbers)
Trust Your Instincts: If something feels wrong, walk away from the transaction

Tijarah is not responsible for any harm, loss, or danger resulting from in-person meetings or transactions.

9. Disclaimer and Warranties

9.1 Platform "As Is"

TIJARAH IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

9.2 No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIJARAH DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

Merchantability or fitness for a particular purpose
Accuracy, reliability, or completeness of listings or user-generated content
Uninterrupted or error-free service
Security of data transmission or storage
Quality or safety of products listed on the platform

9.3 User Risk

Tijarah does not verify, endorse, or guarantee any products, sellers, or buyers
All transactions and interactions are at your own risk
We do not guarantee that any listing is accurate, legal, or available

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY INDIAN LAW:

Tijarah, Shafaqat Tech, and its affiliates shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from your use of the platform
Our total liability shall not exceed ₹1,000 or the amount you paid to use Tijarah (currently ₹0), whichever is less

We are not responsible for:

Product quality, condition, authenticity, or legality
Seller honesty, reliability, or conduct
Transaction completion, payment disputes, or delivery failures
Shipping delays, damages, or lost items
User interactions, meetings, or agreements
Data loss, device damage, or security breaches
Third-party services (Google, Firebase, AdMob)

This limitation applies even if Tijarah has been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless Shafaqat Tech, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

Your use or misuse of Tijarah
Your listings, transactions, or communications
Your violation of these Terms & Conditions
Your violation of any third-party rights (intellectual property, privacy, etc.)
Your violation of any applicable laws or regulations

12. Account Termination & Suspension

12.1 Termination by Tijarah

Tijarah reserves the right to suspend, restrict, or permanently terminate your account at any time, with or without notice, for:

Violations of these Terms & Conditions
Posting prohibited items
Fraudulent activity, scams, or deceptive practices
Harassment, abuse, or threatening behavior
Spam or excessive messaging
Multiple user complaints or reports
Suspected illegal activity
Any conduct that harms Tijarah or its users

12.2 Termination by User

You may delete your account anytime through app settings (Profile > Settings > Delete Account)
Account deletion is permanent and cannot be undone
Your listings will be removed immediately upon account deletion

12.3 Inactive Accounts

Accounts with no activity for 90 consecutive days will be automatically deleted
You may receive a warning notification before automatic deletion

12.4 Effects of Termination

Upon termination, your listings, profile, and account access are removed
Chat messages may persist for other users until they delete conversations
We may retain certain data as required by law or for dispute resolution

13. Intellectual Property

13.1 App Ownership

Tijarah, its name, logo, design, features, and code are owned by Shafaqat Tech
You may not copy, modify, reverse-engineer, decompile, or create derivative works from the app
All trademarks, service marks, and trade names are proprietary to Shafaqat Tech

13.2 User Content Ownership

You retain full ownership of all content you create (listings, photos, descriptions, messages)
By posting content on Tijarah, you grant us a non-exclusive, worldwide, royalty-free license to display, store, and distribute your content on the platform

13.3 Copyright Infringement

Respect intellectual property rights of others
Do not post copyrighted images, logos, or content without permission

To report copyright infringement, email contact.shafaqat.tech@gmail.com with:

Description of the copyrighted work
URL or location of infringing content
Your contact information and copyright ownership proof

We will investigate and remove infringing content promptly

14. Fees and Charges

14.1 Current Pricing

Tijarah is currently free to use for all users
There are no listing fees, transaction fees, or subscription charges

14.2 Future Fees

We reserve the right to introduce fees for premium features, promoted listings, or subscription plans in the future
Users will be notified 30 days in advance of any pricing changes
Continued use after fee introduction constitutes acceptance

14.3 Payment Processing

Any payment processing fees for buyer-seller transactions are the sole responsibility of the transacting parties
Tijarah does not process payments or collect transaction fees at this time

15. Returns and Refunds

All transactions occur directly between buyers and sellers
Tijarah does not process payments and therefore cannot issue refunds
Buyers and sellers must agree on return and refund policies before completing transactions
We strongly recommend discussing return policies with sellers before purchase
Tijarah is not responsible for mediating return or refund disputes

16. Governing Law and Jurisdiction

16.1 Applicable Law

These Terms & Conditions are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

16.2 Jurisdiction

Any disputes arising from these Terms or your use of Tijarah shall be subject to the exclusive jurisdiction of the courts in Srinagar, Jammu & Kashmir, India.

16.3 Dispute Resolution

Before initiating legal action, both parties agree to attempt resolution through good-faith email negotiation for 30 days
If negotiation fails, either party may pursue legal remedies in the designated jurisdiction
Users in India retain all rights under the Consumer Protection Act, 2019

17. Changes to Terms & Conditions

Tijarah may update these Terms & Conditions at any time to reflect changes in:

App features or functionality
Legal or regulatory requirements
Platform policies or procedures

Notification of Changes:

The "Last Updated" date at the top will be revised
Users will be notified of significant changes via in-app notification or email
You may be required to accept updated Terms to continue using the app

Acceptance: Continued use of Tijarah after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the app and delete your account.

18. Severability

If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

19. Assignment

You may not transfer, assign, or delegate your rights or obligations under these Terms to any third party
Tijarah may assign, transfer, or delegate its rights and obligations under these Terms to any successor, affiliate, or third party without your consent or notice

20. Entire Agreement

These Terms & Conditions, together with our Privacy Policy, constitute the entire agreement between you and Tijarah regarding your use of the platform. They supersede all prior agreements, understandings, or communications, whether written or oral.
